The present Terms and Conditions of use of the online store www.valconi.md are applicable to orders for the purchase of products/services offered by the company Sorinlux SRL through the website.
In order to use the site in good conditions, we recommend that you carefully familiarize yourself with the Terms and Conditions presented. We reserve the right to make changes to these provisions without prior notice.
1. GENERAL PROVISIONS
This site is owned by Sorinlux SRL. When registering the order in the online store, the Buyer accepts the Terms and Conditions for the sale of goods/products and/or the provision of services, which are based on the legislation of the Republic of Moldova (hereinafter - Terms and Conditions) presented below.
The use of the website implies acceptance of the Terms and Conditions proposed by Sorinlux SRL, in accordance with Law no. 284/2004 on Electronic Commerce. The relations between the customer and the seller are established on the basis of Law no. 105/2003 on the Protection of Consumer Rights, and other normative acts adopted in accordance with it.
The Seller reserves the right to modify the given Terms and Conditions, and the Buyer is obliged to monitor the modifications.
2. PROTECTION OF PERSONAL DATA
By using the website www.valconi.md, you automatically agree to the collection and processing of personal data, which are necessary for the processing/confirmation/execution of orders.
Personal data is only processed for legitimate purposes, such as providing the products you order, promotions, google analytics, cookies and notifications\newsletter.
All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected and in accordance with the provisions established by Law no. 133/2011 on the protection of personal data.
We use commercial security measures to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information on the site. Data transmission over the Internet or wireless network cannot be fully protected. Therefore, like other companies, we cannot guarantee the security of the information they provide to the Buyer, so they will do so at their own risk.
3. ORDER REGISTRATION AND PAYMENT
Payment of orders is possible with a payment card - upon receipt of the order, you will receive the tax receipt that will confirm the payment.
Online payment is made in conditions of maximum security using the payment card as a payment instrument, which allows online transactions to be carried out. After making the payment you will receive a payment confirmation to your email address.
The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which means a new global approach to buyer authentication in secure online transactions. This security measure involves redirecting the user when making the payment to a secure maib page where the authentication of each cardholder is done by assigning a single-use code for each online transaction.
Refunds are made only to the payment card that was used for the purchase.
To make a payment, you will need to enter your bank card details. The transfer of this information is done in accordance with all necessary security measures. The information is transmitted in encrypted form and is stored only on a specialized server of the payment system.
To make the payment, the following data will be requested:
Card number (16 digits)
Expiry date (month and year)
CVC or CVV code (3 digits)
Name and surname on the payment card
If the currency of the card differs from the currency of the transaction (MDL), then the conditions of the issuing bank will apply to the conversion of the amount withheld from the card account.
4. DELIVERY OF PRODUCTS / GOODS / SERVICES
After registering the order, the buyer is provided with information on the expected date of delivery of the order by the couriers / delivery service.
Delivery within Chisinau is made within 3 days of order confirmation by our operators. Delivery is carried out from 08.00 to 17.00 and is free for orders of at least 500 MDL, for orders with a lower value, the delivery is paid 80 MDL (which will be included in the total amount of the transaction/order) .
Delivery on the territory of the Republic of Moldova is carried out within 48 hours, from the confirmation of the order by our operators. Delivery is carried out from 08.00 to 17.00 and is free for orders of at least 500 MDL, for orders with a lower value, the delivery is paid 80 MDL (which will be included in the total amount of the transaction/order) .
No deliveries are made on Saturday, Sundays or national holidays.
The delivery period may be extended in certain isolated situations (for example: unfavorable weather conditions, periods of public holidays, unforeseen technical problems, etc.). We will notify you if we encounter one of the previously isolated situations.
You can choose any address for delivery – home, office or any other address, without additional payments. We only accept one delivery address per order. If you need to deliver the order to different addresses, please register different orders for each address.
Upon receiving the products, please, in the presence of the courier, check the integrity of the packaging, the presence of the tax receipt. Any subsequent claims regarding these matters will not be accepted.
5. RIGHT OF RETURN
The Customer has the right to revoke the distance contract, according to the following conditions:
In the case of sales and purchase contracts, the Customer may exercise his right of revocation even before acquiring physical possession of the goods.
If the Customer concludes a distance contract for multiple goods, he has the right to revoke the contract only in full, for all the goods that are the subject of it, unless the parties agree otherwise.
The revocation period is 14 days and begins to run:
a) in the case of service contracts, from the day following the date of conclusion of the contract;
b) in the case of sales and purchase contracts, from the day on which the Customer or a third party, other than the carrier and who is indicated by the Customer, takes physical possession of the goods or obtains control over the goods in accordance with art. 1159 paragraph. (1) Civil Code;
c) in the case of the delivery of a good consisting of several lots or pieces, from the day on which the Customer or a third party, other than the carrier and indicated by the Customer, takes physical possession of the last lot or piece;
d) in the case of contracts for the periodic delivery of goods for a specified period of time, from the day on which the Customer or a third party, other than the carrier and indicated by the Customer, takes physical possession of the first good.
In order to exercise his right of revocation, for the purpose of notifying www.valconi.md, the Customer has the possibility:
a) to use the standard form (https://valconi.md/pages/regulament); or
b) to make any other notification, on a durable medium, in which to express his decision to revoke the contract.
www.valconi.md is not obliged to refund the additional costs if the Customer has explicitly chosen a type of delivery other than the standard delivery offered by www.valconi.md. Except in the case where www.valconi.md has offered to recover the goods itself, www.valconi.md may suspend the refund until the date of receipt of the goods that were the subject of the sale-purchase or until the moment of receiving proof from the Customer that he sent the goods to www.valconi.md.
The Customer's obligations in the event of revocation of the contract:
The Customer must send back the goods or hand them over to www.valconi.md without undue delay and no later than 14 days from the date on which the Customer communicated to www.valconi.md his decision to revoke the contract. The deadline is considered met if the goods are sent back by the Customer before the expiry of the respective 14-day period;
The Customer bears the direct costs related to the return of the goods, unless www.valconi.md agrees to bear those costs;
The Customer is responsible for any diminution in the value of the goods resulting from their handling. In order to establish the nature, characteristics and functioning of the goods, the Customer is obliged to handle and inspect them with due care;
www.valconi.md has the right to reduce the amount refunded to the Customer, in accordance with art. 1057 Civil Code, to cover the decrease in the value of the good resulting from its improper handling, other than that necessary to determine the nature, characteristics and functioning of the good, within the term of exercising the right of revocation.
The following types of contracts are exempted from the right of withdrawal provided for above, in relation to distance contracts and contracts negotiated outside business premises:
service contracts, after the full performance of the services, if the performance has begun with the express prior consent of the consumer and after the consumer has confirmed that he has become aware that he will lose his right of withdrawal with the full performance of the contract by the professional;
contracts for the supply of goods or services the cost of which depends on fluctuations in the financial markets, which the professional cannot control and which may occur during the withdrawal period;
contracts for the supply of goods which are not prefabricated, being made on the basis of the individual choices or decision of the consumer or clearly personalised;
contracts for the supply of goods which are likely to deteriorate or expire quickly;
contracts for the supply of sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer;
contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other elements;
contracts for the supply of alcoholic beverages the price of which was agreed upon at the time of conclusion of the sales contract, the delivery of which cannot be made before 30 days and the actual value of which depends on market fluctuations beyond the control of the professional;
contracts for the supply of sealed audio or video recordings or sealed computer programs which have been unsealed after delivery;
contracts for the supply of newspapers, magazines and other periodicals, with the exception of subscription contracts for the supply of such publications;
contracts for the supply of digital content which is not supplied on a tangible medium, if the supply has begun with the consumer's express prior consent and with his confirmation that, at the time of giving his consent, he will lose his right of withdrawal.
In any situation of returning products, they must be in the same condition, sealed, in the original packaging and box, with intact labels and together with all accompanying documents (invoice, tax receipt or other documents), these conditions being cumulative, the absence of one giving www.valconi.md the right to refuse the return and refund the price.
Those products for which the manufacturer has imposed special storage conditions, will NOT be accepted for return.
6. PRIVACY POLICY
In accordance with the provisions of Law No. 133/2011 on the protection of personal data, the service provider processes personal data. Personal data is processed in good faith and is done on the basis of and in accordance with the legal provisions. The processing of personal data is carried out by mixed means (automatic and manual), in compliance with legal requirements and under conditions that ensure security, confidentiality and respect for the rights of the data subjects.
The supplier collects and processes only the personal data provided by consumers when placing the order: name, surname, telephone number, address, postal address.
Personal data is used exclusively for the purpose of administering the site, to allow access to information in particular, for the delivery of orders or to contact the consumer in order to execute the delivery. Through this information, users and consumers become aware of the fact that their personal data will be processed and used (name, surname, telephone number, address, postal address). The service provider processes the personal data of users and consumers that are provided by browsing, using and registering on the website www.valconi.md
Any information provided by the users and consumers of the website www.valconi.md, will be considered and will represent the express consent for the personal data to be used by the Provider.
The provider will not disclose to a third party any of the data held, without the consent of the persons concerned, and will not sell, exchange, disclose this data with other persons, with the exceptions provided by the legislation in force (at the request of the public institutions of the state, legal bodies, courts court, also authorized to process personal data).

The service provider meets the requirements of personal data security and ensures the protection of consumer data and protects it from being lost, destroyed, distorted/falsified or disclosed to third parties.
Employees of the service provider are obliged to respect the confidentiality of personal data of consumers. The processing of personal data will be carried out by the authorized person of the Supplier.
The provider uses security methods and technologies according to the legal provisions in force.
The provider does not collect information related to transactions, such as no. to the card, expiry date, country of origin.
